The Yates County Probation Department is located in the Yates County Courthouse.  It performs vital, mandated functions in both the Criminal and Family Court systems. Regulatory oversight and partial reimbursement comes from the NYS Division of Probation and Correctional Alternatives. Probation is the most frequently used alternative to incarceration and the most common sentence imposed by courts in this country.

Supervision: Individuals sentenced to probation are monitored for compliance with court imposed conditions. Referrals are made to treatment agencies based upon the individual’s needs. Electronic monitoring and community service provide additional sanctions in appropriate cases.

Investigation: Court ordered investigations provide accurate information about an individual’s legal, family situation, education, employment and health. The analysis and recommendation made in each case assists the court in making the most appropriate disposition.

Intake: Juvenile matters are screened to determine if they can be diverted from Family Court action. The PINS Diversion Program is jointly implemented by Probation and Department of Social Services staff. People wanting access to the Family Court for custody or domestic violence problems can obtain the necessary documents to file a petition.

Collections: Court ordered fines and surcharges as well as restitution owed to crime victims are collected and disbursed. Several local laws were established to allow for collection of fees in certain cases.

Ignition Interlock Device (IID) Monitoring: (Leandra's Law) The Yates County Probation Department is the designated agency to monitor the installation and operation of ignition interlock devices in Conditional Discharge cases and Probation cases.  A list of qualified manufacturers and service/installation locations can be found at http://www.criminaljustice.ny.gov/opca/ignition.htm

Alternatives to Incarceration Programs that are operated in Yates County are Pre-Trial Release and Community Service.

Pre-Trial Release: Inmates who are un-sentenced and remanded to Yates County Jail are evaluated for possible release under the supervision of the probation department while their court case is pending. When individuals are considered eligible for the program the information is forwarded to the Judge handling the case who makes the final decision about releasing the person.

Community Service: The community service program oversees the screening and placement of local, non-violent criminals at numerous not-for-profit work sites around the county where they work without pay for a certain number of hours as part of their sentence from the court. The program is mutually beneficial in that the person gives back to the community where they committed a crime and often gains valuable work experience.
